12. Dispute Resolution and Arbitration

Agreement to Arbitrate:
You and Liberty Systems agree that any dispute, claim, or controversy arising out of or relating to this Privacy Policy or our Services (collectively, “Claims“) will be resolved by binding, individual arbitration, rather than in court, except as provided below. This includes Claims based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.
Exceptions: The following Claims are not subject to arbitration:
- Claims brought in small claims court that remain in that court
- Claims seeking injunctive or equitable relief for the alleged unlawful use of intellectual property
- Claims related to or arising from allegations of theft, piracy, invasion of privacy, or unauthorized use
Arbitration Rules: Arbitration will be conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The AAA Rules and filing forms are available at www.adr.org or by calling 1-800-778-7879. The arbitrator will apply applicable substantive law consistent with the Federal Arbitration Act and applicable statutes of limitations, and will honor claims of privilege recognized by law.
Class Action Waiver:
YOU AND LIBERTY SYSTEMS AGREE THAT EACH PARTY MAY BRINGCLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFFOR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE ACTIONOR PROCEEDING. Unless both you and Liberty Systems agree otherwise, the arbitrator may not consolidate or join more than one person’s or party’s claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding.
Pre-Arbitration Notice Requirement:
Before initiating arbitration, you must send written notice to Liberty Systems at
N22W22922 Nancys Ct, Waukesha, WI 53186, describing the nature of the Claim and the relief sought. We will attempt to resolve the dispute informally within 60 days of receiving your notice.
Arbitration Costs:
Each party will be responsible for its own costs and fees associated with arbitration, including arbitration filing fees, arbitrator fees, and attorney’s fees, except as may be required by applicable law or awarded by the arbitrator.
Opt-Out Right:
You may opt out of this arbitration agreement by sending written notice to privacy@lsn2.com within 30 days of the date you first accept this Privacy Policy. Your notice must include your name, address, email address, and a clear statement that you wish to opt out of the arbitration agreement.
Governing Law and Venue:
This Privacy Policy and any Claims not subject to arbitration shall be governed by the laws of the State of Wisconsin, without regard to its conflict of laws principles. Any Claims not subject to arbitration shall be brought exclusively in the state or federal courts located in Waukesha County, Wisconsin, and you consent to the personal jurisdiction of such courts.
Severability:
If any provision of this arbitration agreement is found to be unenforceable, the remainder shall continue in full force and effect. If the class action waiver is found to be unenforceable, the entire arbitration agreement shall be null and void.
